ELECTOR'S QUALIFICATIONS

  • To be eligible to vote in a Snaw’naw’as First Nation Election, an individual must:
  • have their name registered on the Snaw’naw’as First Nation Membership List; and,
  • be 18 years of age or older on the election date.

NOMINATION PROCESS

  • The Electoral Officer shall post notice of a nomination meeting, and mail notice of a nomination meeting and nomination forms to non-resident members at their Address of Record, that states which Offices of Chief and Council are open to nomination not later than thirty (30) days prior to the Nomination Meeting.

Nomination Meeting

  • The nomination meeting will be held at an accessible location on Snaw’naw’as First Nation -held land on a date to be determined by the Electoral Officer in accordance with this Code.
  • The meeting will commence for the purposes of nominations at such time as is determined by the Electoral Officer and be declared closed for nominations two hours after the commencement time.

To Be Nominated by Five Electors

  • An individual will be declared nominated if five electors of the Snaw’naw’as First Nation move and second that the individual be nominated for the Office of Chief or the Office of Councilor.
  • To be valid, nomination forms mailed to the Electoral Officer in lieu of nominations made on the floor of the nomination meeting must be received by the Electoral Officer no later than two hours prior to the commencement of the Nomination Meeting.

Limitation on Number of Nominations any Elector may make.

  • Each elector may nominate or second no more than:
  • one (1) eligible person for the Office of Chief; and
  • the number of eligible persons equivalent to half of the vacancies for the Office of Councilor.

In the case of a Special Election each elector may only nominate or second no more than half of the number of eligible persons equivalent to the vacancies in the Special Election except if that number is one (1) in which case one (1) nomination may be made by each elector.

  • No elector shall nominate any person who has already been nominated. Therefore, if a candidate has been nominated for the position of Chief, they cannot also be nominated for the position of Councilor.

Accepting Candidacy

To become a candidate, nominees must accept their nomination in writing by filling out the Candidacy Acceptance form and submitting this form to the Electoral Officer no later than close of business on the third day following the day of the Nomination Meeting.

  • No person shall accept candidacy in a Snaw’naw’as First Nation Council election if that person is not eligible to be a candidate in accordance with this Code.

ELECTION BY ACCLAMATION

  • If the number of persons nominated does not exceed the number of vacancies at the end of the nomination meeting and the nominees accept their candidacy in accordance with section 9.8 of this Code, the Electoral Officer shall declare such persons elected by acclamation.

GRANTING OF POLL

  • If the number of candidates exceeds the number of vacancies, the Electoral Officer will declare that an election be held on the designated date. The date of the election shall be at least thirty-five (35) days but not more than sixty (60) days after the nomination meeting.
  • Upon the expiry of the section 9.8 acceptance of candidacy period, the Electoral Officer shall post a notice in a conspicuous public place, setting out the time and place and date
  • for voting and also mail the notice and ballots and other electoral materials to non-resident members. This notice shall be posted, and the mail-out conducted not less than thirty (30) days prior to the date scheduled for the election.

ELECTORAL CAMPAIGN

  • Election Campaigns are to be conducted in an open, fair, honest and transparent manner.
  • Election Campaigns will have at least one Candidates’ Forum/Debate organized by the Electoral Officer. This Forum/Debate must be held no less than fourteen (14) days and no more than twenty-one (21) days from Election Day.
  • The Electoral Officer will facilitate candidate communications with the electorate through one coordinated mail-out of candidate's campaign literature at such time as is determined by the Electoral Officer. Any candidate who has not provided campaign literature at least four days prior to the time of distribution will not have that literature included in the mail-out
