VOTING, COUNTING, AND REPORTING

  • The Electoral Officer shall ensure that all preliminary procedures are conducted and all materials required for conducting a vote are provided.
  • Voting for Council elections shall be conducted by secret ballot.
  • Each elector may vote only once in an election.
  • All off-reserve electors residing in the area shown on the map included in Appendix A have the right to vote in Snaw’naw’as First Nation Council elections through a mail-in ballot.
  • There shall be an Advance Poll seven days prior to Election Day.
  • Votes shall be publicly counted upon the close of the polls.
  • The results of the vote shall be posted in a conspicuous public place and included in a post election mail-out to non-resident electors.
  • If a tie results in any election, a public recount will be conducted as soon as practicable.
  • If a tie remains after a recount, the tie shall be resolved at the inaugural meeting of the newly-elected Council. Each member of Council excluding those who have tied, shall have one vote to cast by secret ballot for the purpose of breaking the tie.

ELECTION OF SUW’EN SCI’EM AND SPOKESPERSON FROM EACH FAMILY

Nomination Date

The Electoral Officer will establish the date for receiving all nominations for the election of Suw’en Sci’em and Spokesperson and shall advise the members of the Snaw’naw’as First Nation by posting the said date at the Band Office and in two or more conspicuous places in the community of the Snaw’naw’as First Nation, but the date of such meeting will be no later than the 15th day of October in any such year.

Proceedings at the Nominations Meeting

(1)On the date of the nomination meeting, the Electoral Officer will declare the meeting open for the purpose of receiving nominations.

(2) Any person who is the member of the Snaw’naw’as First Nations and is registered as a member of the Families of the Snaw’naw’as First Nation may propose or second the nomination of a member of the Snaw’naw’as First Nations to stand as councillor.

(3) All nominations so put forward must be seconded and accepted by the person being nominated.

(4) Only members of the Snaw’naw’as First Nation can be nominated to hold position as councillor.

(5) The Electoral Officer will call three (3) times for nomimations and after the third request, and if there is no response, the Electoral Officer will declare the nominations closed.

(6) The Electoral Officer will not close the said nominations, however, until such time as the Electoral Officer has received a minimum of one (1) nomination for Suw’en Sci’em from each Family and a mmimum of two (2) for Spokesperson from each Family.

(7) If the number of members nominated per family does not exceed one for Suw’en Sci’em and two for Spokespersons, the Electoral Officer shall declare those persons so nominated as acclaimed nominees for Electoral to the Band Council.

(8) In the event that more than the required number of nominations are received for either the position of Suw’en Sci’em or the position of Spokespersons for a Family, then an election will take place for such positions, wbich election is called a "Family Poll" subject to the paragraph below.

(9) If, prior to the election, the Family members decide to withdraw a name so as to not exceed the number of positions for Suw’en Sci’em and Spokespersons, and the Family unanimously agrees to the same by a show of hands, the Electoral Officer will then announce the remaining nominees as acclaimed nominees for Electoral to the Band Council.

 

FAMILY POLL

  • The Family Poll, if required, will take place on the fourth (4th) day after the nomination meeting.
  • The time and date of the Family Poll will be posted by the Electoral Officer in the Band Council office and in two other conspicuous places of the Snaw’naw’as First Nations’ land at least two (2) days prior to the actual Poll indicating in the notice the date, the time, and the place of the Poll.
  • Only the members of the Family directly effected by the election of the Suw’en Sci’em or the Spokespersons will be eligible to vote.
  • The Electoral Officer shall provide separate ballot papers to the members of the Family with one ballot paper for the election of the Suw’en Sci’em and another ballot paper for the election of the Spokesperson if such elections are required.
  • The Electoral Officer will:

(a) procure a ballot box with sufficient ballot papers;

(b) seal the box with tape and inscribe his initials on the tape until the election is over;

(c) provide a booth and a polling station to the Family members;

(d) allow the election to take place between 9:00 a.m. and 9:00 p.m.
