MEMBERSHIP

Members

(1) The members of the Snaw’naw’as First Nation are those individuals over the age of eighteen (18) and who are also members of one of the four Families of the Snaw’naw’as First Nations which are listed in Appendix "A".

(2) All members shall keep the Council advised of their current addresses and changes of such addresses.

(3) The Council will keep an active membership list of all members of the Snaw’naw’as First Nation which list will show all members of the Band and a separate list which will show all of the members belonging to a particular Family as defined in Appendix "A".

(4) A member may apply to the Council to have the membership list revised on grounds that the name of the member is incorrectly set out therein or the name of a person not qualified as a member is included therein.

 

MEETINGS OF MEMBERS

General Meetings

(1) General Meetings of the membership shall be held at such times and places as the Council decides or upon a request made in writing to the Council by ten per cent (10%) or more of the membership.

Address for Notice

(1) A notice may be given to a Member, either personally or by mail, to their registered address, or by posting of the notice in the office of the Council and at least two other conspicuous locations of the lands of the Snaw’naw’as First Nations.

Date of Notice

(1) A notice sent by mail shall be deemed to have been given on the third day following that on which the notice is posted and in proving that the notice has been given, it is sufficient to prove that the notice is properly addressed and put in a Canadian Post Office receptacle.

Notice of General Meeting

(1) Notice of a General Meeting shall specify the place, the day and the hour of the meeting, and in the case of special business, the general nature of the business.

(2) The accidental omission to give notice of a General Meeting to, or the non-receipt of a notice by, any of the members entitled to receive notice does not invalidate proceedings at that meeting.

(3) The Band Council shall give not less than twenty-one (21) days’ written notice of a General Meeting to its members and the notice shall specify any special business intended to be introduced and any proposed special resolution.

 

PROCEEDINGS AT GENERAL MEETINGS

 

Quorum

(1) The quorum at any General Meeting shall be twenty (20) members entitled to vote or one third (of the total number of members, whichever shall be the lesser.

(2) No business shall be conducted at a General Meeting at a time when a quorum is not present.

Absence of Quorum

(1) If within thirty (30) minutes from the time appointed for a General Meeting a quorum is not present, the meeting, if convened on the requisition of members shall be terminated; but in any other case, it shall stand adjourned to the same day in the next week at the same time and place and if at the adjourned meeting, quorum is not present within thirty (30) minutes from the time appointed for the meeting, the members present constitute a quorum.

CHIEF

(1) The Chief shall preside as Chair of a General Meeting.

Resolution

(1) A resolution proposed at a General Meeting must be seconded.

(2) The Chair has a vote but will normally remain neutral and will not exercise the right to vote until such time as the Chair may deem it vitally important to make or break an equal vote for the good of the membership.

  • A Member in good standing present at a meeting of members is entitled to one (1) vote.

(2) Voting is by show of hands unless a motion for a ballet vote is passed.

(3) Voting by proxy is not permitted.

(4) An ordinary resolution receiving a majority vote will be deemed to have been carried
