Snaw’naw’as First Nation Government

The Snaw’naw’as First Nation Council is elected to office as a body of political representatives of the citizens of the Snaw’naw’as First Nation.

The Councillors may exercise all such powers and do all such acts and things as the membership collectively may do or exercise which are not prevented by these Regulations.

Office of Chief

(1) There shall be one (1) Chief of the Snaw’naw’as First Nation.

(2) The Office of Chief shall be elected by a majority vote .

Candidacy for Office of Chief

  • Subject to this Code, a candidate for the Office of Chief must:
  • be an eligible elector as defined in Part 8 of this Code; and
  • be ordinarily resident within the Snaw’naw’as First Nation Candidacy Area as described in Appendix B.

Term of Office for the Office of Chief

  • Subject to other provisions of this Code, the term of the Office of Chief shall be four (4) years.

Office of Councilor

  • There shall be four (4) Councilors of the Snaw’naw’as First Nation.
  • The Offices of Councilor shall be elected by a plurality of the vote.

Candidacy for Office of Councilor

  • Except as provided under sections 4.10 - 4.14, a candidate for the Office of Councilor must:
  • be an eligible elector as defined in Part 8 of this Code;
  • be ordinarily resident within the Snaw’naw’as First Nation Candidacy Area as described in Appendix A.

Term of Office for Councilor

  • Notwithstanding other provisions of this Code, the term of Office of a Councilor shall be four (4) years.

Limitations on Holding Office

  • Persons holding the following Snaw’naw’as First Nation positions shall not be eligible to be a candidate for the Office of Chief or the Office of Councilor in Snaw’naw’as First Nation elections. These include but are not limited to:
  • the Snaw’naw’as First Nation Council Secretary;
  • the Band Manager or Administrator;
  • the Financial Officer; and,
  • any person employed by the Snaw’naw’as First Nation who reports to, and is under the direct supervision of the Snaw’naw’as First Nation Chief or a Snaw’naw’as First Nation Councilor or the Snaw’naw’as First Nation Council.

Conduct Related to Candidacy Rights

(1) Any individual that has been found to be guilty, in connection with an election, of corrupt practice, bribery, accepting a bribe, dishonesty or malfeasance is not eligible to be a candidate for the Office of Chief or the Office of Councilor for a period extending from the date of conviction to five (5) years after completion of a sentence, unless officially pardoned.

  • A person who has been found guilty of a criminal offence is not eligible to be a

candidate for the Office of Chief or the Office of Councilor in an Snaw’naw’as First Nation election for a period extending from the date of conviction to five (5) years after completion of a sentence, unless officially pardoned.

  • Any individual that was found to have vacated their Office through subsections 6.1 (b) 6.1(g) of this Code, shall not be eligible to be a candidate in the special election to fill that vacancy.
  • Notwithstanding section 4.12 or section 6.1 (c), any individual that has been found guilty of an offence for actions undertaken on behalf of the Snaw’naw’as First Nation for the purpose of protecting, enhancing, or exercising Snaw’naw’as First Nation aboriginal or treaty rights shall not be ineligible to be a candidate in Snaw’naw’as First Nation elections or for holding the Office of Chief or the Office of Councilor, for this cause alone.
